Mission & Goals
The aim of this lobby is to represent and defend those affected by fraud in the abusive nature of temporary employment in the Spanish public sector, which involves more than 800,000 civil servants. For several years, the Kingdom of Spain has been in breach of Directive 1999/70/EC and the case law of the Court of Justice of the European Union. In response to this, the Kingdom of Spain has launched legislative proposals that continue to violate Community legislation and case law. For this reason, the purpose of this lobby is to inform the European institutions of the problems that are occurring in Spain and to find a solution that does not leave this group of injured parties in a situation of defenselessness.
EU Legislative Interests
The main EU policy area in which this lobby is interested is employment and social affairs policy. The objective is the correct implementation of Directive 1999/70/EC by the Kingdom of Spain with regard to the abuse of temporary contracts suffered by Spanish public administration employees. This fraud of law has been denounced to the European Commission and has received the registration number CHAP (2013)01917. In response to this, the European Commission initiated an infringement procedure with number 2014/4334, in which it claimed that Spanish law was incompatible with clause 5 of Directive 1999/70/EC, which is still ongoing. However, the problem is still present in Spain. Therefore, the present lobby has as its object of interest the appropriate compliance with European regulations in accordance with the employment and social affairs policy for its correct application in the Member States.
