The Electronic Frontier Foundation is the leading nonprofit organization defending civil liberties in the digital world. Founded in 1990, EFF champions user privacy, free expression, and innovation through impact litigation, policy analysis, grassroots activism, and technology development. We work to ensure that rights and freedoms are enhanced and protected as our use of technology grows. Even in the fledgling days of the Internet, EFF understood that protecting access to developing technology was central to advancing freedom for all. In the years that followed, EFF used our fiercely independent voice to clear the way for open source software, encryption, security research, file sharing tools, and a world of emerging technologies. EU Legislative Interests

Working on the enforcement/implementation of the Regulation (EU) 2022/2065 of the European Parliament and of the Council of 19 October 2022 on a Single Market For Digital Services and amending Directive 2000/31/EC (Digital Services Act) Working on the enforcement/implementation of the Regulation (EU) 2022/1925 on contestable and fair markets in the digital sector and amending Directives (EU) 2019/1937 and (EU) 2020/1828 (Digital Markets Act) Working on the Proposal for a Regulation laying down rules to prevent and combat child sexual abuse COM/2022/209 final Working on the enforcement/implementation of the Regulation establishing a common framework for media services in the internal market (European Media Freedom Act) Working on the enforcement/implementation of the Regulation (EU) 2024/1689 of the European Parliament and of the Council of 13 June 2024 laying down harmonised rules on artificial intelligence (Artificial Intelligence Act). Communication Activities

We are accompanying the implementation process of the Digital Services Act (DSA) and and the Digital Markets Act (DMA), focusing on implementation challenges. Among others, we will advocate for a human-rights centered enforcement approach of the DSA, which should also include the inclusion of international voices and assess the global implications of EU law enforcement. https://www.eff.org/pages/dsa-human-rights-alliance#main-content As regards the DMA, we will have a focus on device neutrality, app store freedom, user choice, and interoperability. On the latter, we will work to ensure that the interoperability mandate can work in practice, meeting security expectations and the expectations of internet users. https://www.eff.org/pages/adoption-dsadma-notre-analyse. We support the EU to explore fostering interoperability between social networking services to enable more user choice, making sure that technical experts and civil society are consulted in the process. On competition policy in general, EFF wishes to highlight that regulating gatekeepers is only one instrument to make digital markets more competitive and foster innovation. The EU should consider adopting policies to champion alternatives and strengthen the public interest internet and open-source projects, with a focus on fostering an open internet. We are dedicating advocacy work efforts to the effects of the European Media Freedom Act, in particular related to the provision on spyware and the new media exemption related to content moderation. https://www.eff.org/deeplinks/2023/12/latest-eu-media-freedom-act-agreement-bad-deal-users Furthermore, we are following the implementation of the eIDAS Regulation, which must protect fundamental rights, including privacy, free expression, and participation, and must pursue the highest levels of data protection and security, particularly in the context of age verification We will also advocate to ensuring net neutrality in the upcoming EU Digital Networks Act. https://www.eff.org/issues/net-neutrality EFF will have a strong priority on making sure that the EU safeguards encrypted communication and resist any attempts to circumvent end-to-end encryption through backdoors or client-side scanning. We will articulate policy suggestions in relation to the "Chat control" proposal and follow closely the related debates. EFF will advocate for the EU to adopt a privacy-first approach to fighting online harms. This includes work on age verification, targeted ads, deceptive designs and other measures related to the excessive collection and processing of users' data. On the regulation of artificial intelligence, we will advocate for a rights-respecting enforcement of the AI Act: We are concerned that the law enforcement exceptions risk undermining key safeguards, such as limitations on face recognition and predictive policing and we will advocate for the EU to prioritize a robust, rights-based enforcement of the AI Act, which protects against discrimination and surveillance through AI systems.
